Legal Gambling in Indian states

The Seventh Schedule of the Constitution of India, List I and List II, empowers state governments to authorise and conduct lotteries and amend laws on gambling if they choose. While most of the states are against gambling, 13 states have legalized lottery and two states, Goa and Sikkim, have legalized other forms of gambling.

Legal Gambling in Goa

Goa has around 7 land based casinos and many offshore casinos. These are operational because Goa has made two amendments to ‘The Daman and Diu Public Gambling Act, 1976’ – Amendment Act 11 of 1992 and Amendment Act 13 of 1996 to legalize various forms of gambling at five star hotels or offshore vessels.

Legal Gambling In Sikkim

‘The Sikkim Casino Games (Control and Tax Rules), 2002’ and ‘The Sikkim Regulation of Gambling (Amendment) Act, 2005’ give Sikkim Government the discretionary power to legalise and authorise gambling on certain days in the state. It has also become the first Indian State to legalise Internet gambling. ‘The Sikkim Online Gaming (Regulation) Act, 2008’ and ‘The Sikkim Online Gaming (Regulation) Rules, 2009’ allows the state to license online gambling websites.
